The mobile application “Top Parent” (hereinafter referred to as the “Platform” or “Top Parent”) is owned, maintained, operated, and managed by Humanitus Learning Sciences and Consulting Services Pvt. Ltd. (hereafter referred in this document as “Humanitus”/ “We”/ “Us”). This Privacy Policy ("Policy") describes how We, Humanitus Learning Sciences and Consulting Services Pvt. Ltd. (referred to as "Top Parent", "We", or "Us") handle personal information of natural persons ("You" or "User") collected or otherwise processed when using Services (as defined below) of Top Parent. Top Parent is a public goods product designed to serve the educational and developmental needs of families with young children.
Top Parent provides certain services including our mobile application (the “Application”) and related software services as more particularly described in our Terms and Conditions (“Services”). We want you to know that your trust is key to the success of our business. We take privacy and confidentiality very seriously and we safeguard all information in accordance with this Policy. In this Policy “Personal Information” means personal information about an identifiable individual and information which can be used to identify an individual. We don’t require disclosure of more information than is reasonably necessary to participate in any educational activity/service;
Top Parent generally processes Personal Information in order to fulfill contracts we have with our customers and Users and to provide quality educational services to our users. In this policy, we refer to individuals younger than age 8 as “Children”. We provide this privacy policy to inform parents and other users about our privacy practices for humanutus.in, topparent.org, Top Parent app, and services that link to this privacy policy. Even though our Platform is focussed on educating Children, it is to be accessed by and used by Parents/Guardians and no child is allowed to use the Platform without parental guidance and control. Top Parent is devised in a way that the Registrants or Users are Parents or legal guardians of Children/minor students and collects information from Parents or legal guardians.
Humanutus.in, topparent.org, Top Parent app, and any other Top Parent educational games and educational services are only to be used in the Indian territory. To make this Platform secure for use by children, we do not allow in-app purchases or advertisements of any manner.
This Privacy Policy does not apply to the practices of companies that we do not own or control.

1) Meaning of Terms used in this Privacy Policy:
a) When this Policy uses the term "Information" or "Personal Information" in capital letters, we mean information that identifies a particular individual, and the information we collect to help you create a Profile on Top Parent such as your contact number, full name, address, age of your child and any other information that we may decide to collect for better processing and functioning of Top Parent. “Personal Information” may also be interchangeably referred to as “Data”.
b) When this Policy uses the term "Top Parent", We mean the mobile application and website named Top Parent and owned and run by “Humanitus Learning Sciences and Consulting Services Pvt. Ltd.”.
c) When this Policy uses the term "Account", We mean the user interface on the Top Parent where You can register. Such registration is a prerequisite to use Top Parent.
d) When this Policy uses the term "Services", We mean educational content and services for children provided by Us to our Users through our Mobile Application.
e) When this Policy uses the term "End User" “Registered Users”, “Users” and “Customers”, we mean any end user of Top Parent. The term “Registrants” refers to all individuals who are registering on our Platform Top Parent in order to avail our Services. Both User and Registrant will be parents/legal guardians of Children.
2) What personal information we collect: Depending on how you use our Services and Top Parent, we might collect the following kinds of information:
a) As a user of Top Parent, we collect information such as your name, phone number, address, and information about the age of your Child.
b) We may also collect other information from you about your child which is optional and will be collected solely at your discretion. Only provide such information if you are agreeable to the same.
c) We may also collect details of other interactions with us, together with any other information provided to us;
d) We seek consent for using our Services to collect and use the information.
e) Users who do not give this consent (or do not have this consent provided on their behalf) cannot provide us with their information and cannot use our Services and the Top Parent.
f) You can withdraw your consent at any time by contacting us at info@humanitus.in.
g) We do not collect any unnecessary personal information from Users and/or Registrants.
h) The information collected by Top Parent is reflected on the Profile of the Registrant or User.
i) Users may also have the option of uploading their photographs on their profile on Top Parent. This is however completely optional and shall be done at the User’s discretion. Top Parent does not mandate uploading of photographs and shall not be liable for such photographs in any manner. The User shall also ensure that they are not using/uploading their child’s photo or any insulting, derogatory, insensitive, indecent, or inciting photo on the profile. Their account may be suspended if found to be in breach.
We collect specific information as specified herein and majorly collect Non- Personal Information (which is being referred to as “information” herein).
Other Information:
j) Top Parent may also collect information such as the age of your child in order to showcase the same on your profile, provide you Services that are relevant and that we provide through our Platform.
k) While Top Parent only collects the personal information that is mentioned hereinabove, 3rd Party Apps that the Users will use through the Top Parent might also collect certain information with respect to usage of the Services. Such information is collected by the 3rd Party App and such services are governed by their respective policies, terms and conditions, etc.
l) Top Parent shall not be liable for any events that occur on 3rd Party Apps and the User must check the policies of such 3rd Party Apps.
i) We do not transmit Android advertising identifier (AAID), SIM Serial, Build Serial, BSSID, MAC, SSID, IMEI, and/or IMSI from Users.
ii) We do not request device phone number from Telephony Manager of the Android API.
iii) We do not request, collect, use, or transmit the location of Users.
iv) When we request bluetooth access for any Service, we use Companion Device Manager (CDM) unless only targeting device Operating System (OS) versions that are not compatible with CDM.
3) How we handle your information
The information collected from Users, customers, or prospective customers may be used for the following purposes:
● to send a confirmation notice or to authenticate the Registrant for the registration;
● to provide access to our services, or to provide offers for, and updates about, our products and services;
● to administer and manage accounts, including responding to questions raised by Registrants, to contact the Registrant about any problems with the Registrant’s account or conduct on Top Parent.
● to send out details about Top Parent including information about current events, changes, improvements, upgrades, and rules of Top Parent.
● for administrative, planning, product or service development, quality control, and research purposes relating to our Services.
● for information related to a user’s child's performance, learning progression and development.
● to identify your likes and dislikes and help us improve your user experience.
We use the personal information we collect about you from different sources and touchpoints to try and understand more about you and your preferences so that we can personalise the service we offer to you.
4) How long we hold your information
We retain the personal information that we collect for as long as it is needed to provide Services and to manage the concerned Registrant’s account. In the event that the User deletes their account, we will be retaining their personal information for a period of ninety (90) days.
We take reasonable steps to deal with the personal information we collect, if your registration to use Top Parent lapses and/or you opt-out of receiving further communications from us, or if you ask us to delete your information. We may, however, retain and use personal information as necessary to comply with our legal and regulatory obligations, to resolve disputes and to enforce our agreements, and we may retain and use anonymous and aggregated information for performance reporting and analytic purposes and for product and service improvement.
Registrants can request that their personal information be deleted by contacting us on info@humanitus.in. We will be making all possible endeavours to delete such personal information within a period of 4-7 working days.
5) How we protect your information
We make all possible endeavours to protect your information against unauthorised access, unlawful use, accidental loss, corruption, or destruction.
We use optimum operational measures to protect the information, for example by limiting the number of people who have access to the databases in which personal information is held.
We keep these security measures under review and refer to industry security standards to keep up to date with current best practices.
We also use certified 3rd Party Servers, which undertake to secure our Data and entire product/app with industry security standards.
Responsible Entity, Contact Details, How We Deal With Your Information in General
a) The responsibility for processing personal information lies with Us, i.e. by using Top Parent and by providing us information you accept and undertake that you are 18 years of age and above. We do not allow individuals below the age of 18 years or any applicable legal age where the individual is considered to be of legal age to enter into a valid agreement, to register on Top Parent on behalf of a child.
b) If you have any question or inquiry relating to Our use of Your personal information or in case You want to issue a request for access, rectification, restriction on processing, portability, objection to processing, or deletion of personal information, or exercise any other right available to you under the Indian Privacy Laws You may contact us at info@humanitus.in.
c) We use Your Information for the purposes described hereinbelow, and do not share it with third parties, unless explicitly set out otherwise by Us in this Privacy Policy.
d) We share your information with business partners on an as-needed basis to render the Services.
e) In the event that we sell our business, i.e. all or substantially all of our assets are sold or transferred to or merged with another party, all Information/Data that has been collected and stored may be one of the business assets we transfer.
f) In the event we are required to respond to summons, court orders or other legal process your Information may be disclosed pursuant to such summons, court order or legal process, which may be without notice to You.
6) Consent

By using our Services and supplying information to us, or by using the Top Parent, you consent to the collection, use and disclosure of your Personal Information by us for the purpose of providing Services to you via Top Parent, and administering your account in accordance with: (a) this Policy, (b) any other agreement you may have entered into with us, and (c) applicable laws and regulations. It is your responsibility to ensure that we are kept informed of the correct and current contact information for you.

We take the Parent’s or legal guardian’s consent prior to collecting Personal Information.

If you are a minor student/Child, do not register on Top Parent and only seek your parent to do so.

That the User or Registrant (Parent) is sharing verifiable parental consent prior to letting your child (or children) use or access 3rd Party Apps through Top Parent and is sharing all personal information only subsequent to giving us such express consent.
7) Information You Submit to Register an Account
If you leave your details on Top Parent to create an account, which is a prerequisite to subscribe to Our Services, we request your contact details, name, address, etc. We collect this information to be able to connect with you and contact you and to send you information relating to the use of our Services.
We also use third-party analytics services. When a user browses or uses the Services, these third-party analytics services may collect the user’s IP address, browser type, and approximate location (based on the IP address).
8) Sharing your information
We do not share your personal information with any categories of third parties. We may, however, share certain identifier numbers and/or individually identifiable information with State Governments or other Government bodies only upon express direction from such Government entities. These Government bodies shall expressly issue instructions to the Registrant to provide the information to us, and only in such scenarios will we be collecting such information.
9) Your Rights
Top Parent aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Information.
Whenever made possible, you can update your Personal Information directly within your account settings section. If you are unable to change your Personal Information, please contact us to make the required changes.
If you wish to be informed what Personal Information we hold about you and if you want it to be removed from our systems, please contact us.
In certain circumstances, you have the right:
● To access and receive a copy of the Personal Information we hold about you;
● To rectify any Personal Information held about you that is inaccurate;
● To request the deletion of Personal Information held about you;
● To limit further processing, disclosure or use of your Personal Information.

Where your Information is collected by 3rd Party Apps, we will refer your request to the applicable 3rd Party Apps. You can send us a request to our email info@humanitus.in and we will respond to it promptly. We will ask you to verify your identity before responding to such requests in any manner.
10) Updating and accessing your personal information
Registrants have a right to request a copy of the personal information Top Parent holds about them, and Registrants can also update their personal information at any time, in each case by contacting us.
If you wish to receive a copy of this information or to update or correct information held about you, please address your request to the contact details provided below. We will endeavor to deal with your request promptly.
When you get in touch, we will come back to you as soon as possible and where possible within one month. If your request is more complicated, it may take a little longer to come back to you but we will come back to you within two months of your request. We may also ask you to verify your identity before we provide any information to you.
11) Hosting, Data Retention and Security
a) We retain Personal Information for as long as we need it to fulfill the purposes for which we have initially collected it, unless otherwise required by law. We will retain and use information as necessary to comply with our legal obligations, resolve disputes, security, and enforce our agreements
b) We use reasonable organizational, technical and administrative measures to protect Personal Information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. 12) Your Choices
In certain cases, you may have choices about how we use and disclose your personal information. For example, we will ask you before we use your personal information for any purpose incompatible with those purposes identified in this policy.
You can also choose not to give us the information we request, as described in the “Information You Provide to Us” section of this policy. In some cases, if you decide not to provide information, we will not be able to provide you with access to the site you requested, or we may not be able to provide you with the service, feature, or information you requested.
13) Access and Correction
We will provide you with the ability to access and update certain information we have about you, such as the contact information you provide as part of your registration process. Please submit your request by sending an email to the address specified in the “Contact Us” section below. Please include your name, email address and postal address in your request so that we may respond appropriately.
14) Links to Other Sites
We allow 3rd Party App listings on our Platform so you are able to access them. We make all possible efforts to ensure that we are partnering with apps that are lawful, legally compliant, and most importantly, promote education for Children. We may also provide links to other sites for your convenience and information. These sites are operated by organizations not affiliated with Top Parent, so we cannot control and are not responsible for their content, operation, or privacy practices. Those organizations may have their own privacy policies, which we strongly suggest you review if you use other sites. This Notice does not apply to those sites, even if we link to them or they link to us.
We also have integrations with WhatsApp API for messages, Gupshup for text messages, and Clevertap SDK for tracking. We are not responsible or accountable for any such information and you must read their independent policies and terms and conditions, etc. before proceeding with them.
15) The Legal basis for using Personal Information:
We will only collect, use and share your information where we are satisfied that we have an appropriate legal basis to do this. This may be because:
● you are an individual of 18 years of age and above;
● you have provided your consent to use the Information;
● Our use of your Information is necessary to for using our Services;
● Our use of your Personal Information is in our legitimate interest to provide you enhanced services subject to involved parties’ interests and fundamental rights.
● Our use of your Personal Information is necessary to comply with a relevant legal or regulatory obligation that we have (e.g. the disclosure of information to law enforcement or tax authorities).
16) Confidential information
Top Parent shall establish and maintain reasonable procedures to protect the confidentiality, security, and integrity of personal information collected.
17) Limitation of Liability
That Top Parent takes all reasonable care and caution to store the Information safely. However, Top Parent shall not be held liable for any type of breach of data or attack on its Data Systems or Stored Data, since no Data system is completely breach-proof. Any User who has an issue with this is requested/directed to not sign up or Register on Top Parent.
18) Communication
You authorize us to communicate with you regarding our Services and your account. You authorize us to communicate with you via the contact number that you have provided. You understand and accept the risk that data and information transmitted on any Platform or through any medium is susceptible to error or security breaches.
19) Revision of Privacy Policy
Top Parent reserves the right to change, modify, or revise this Privacy Policy in order to comply with any applicable laws, to reflect changes in our processes or for any other reason at any time. Material changes in our Privacy Policy will be communicated to Registered Users and customers, but we also encourage our Registrants to check the Privacy Policy periodically to read about any changes, modifications, or revisions. Registrants may wish to check it each time they submit personal information. You will be deemed to have consented to such variation by your continued use of the Site following any changes being made.
20) Special Information for users located in different parts of the world:
Top Parent is only meant for users based in India. While we deal with Information in manners and ways that are compliant with laws and regulations that are applicable globally, our platform is strictly meant for use in India, for users in the Indian territory and governed by Indian laws.
The Privacy policy is also compliant with the EU General Data Protection Regulation (GDPR) law and the Children's Online Privacy Protection Act which are both an essential set of regulations to affirm our commitment to data protection across the European Union. Which is why, We are committed to ensuring:
a) Personal data is processed fairly, lawfully and in a transparent manner
b) Personal data is collected and processed only for specified and lawful purposes
c) Processed data is adequate, relevant and not excessive
d) Processed data is accurate and, where necessary, kept up to date
e) Personal data is not kept longer than necessary
f) Personal data is processed in accordance with an individual’s rights;
